Welcome to My Sleep: Health Tracker (hereinafter referred to as “the App”). Please read this Terms of Service agreement (“Agreement”) carefully before using the App. By accessing or using the App, you agree to be bound by this Agreement.

If you do not agree with any part of this Agreement, please stop using the App.

 

1. Scope of Agreement

This Agreement applies to your download, installation, registration, login, and use of My Sleep: Health Tracker and its related features and services.

 

2. Eligibility

lYou must be at least 16 years old to use the App.

lIf you are under 18, you may only use the App under the supervision and consent of a parent or legal guardian.

lYou must ensure that the registration information you provide is truthful, accurate, and complete.

 

3. Accounts and Use

lSome features of the App may be used without an account.

lIf you create an account, you are responsible for safeguarding your login credentials and must not transfer or share them with others.

lThe App is not responsible for any loss or damage caused by your failure to protect your account information.

 

4. User Conduct

When using the App, you must not:

lViolate any applicable laws or regulations;

lInfringe upon the rights of others, including privacy and intellectual property rights;

lCollect or process data unlawfully;

lInterfere with or disrupt the normal operation of the App;

lCopy, modify, reverse engineer, or create derivative works of the App without prior permission.

 

5. Intellectual Property

lAll content in the App, including but not limited to software code, interface design, text, images, and audio, is protected by law.

lYou may not use, copy, distribute, or create derivative works without prior authorization.

 

6. Data and Privacy

lWe collect and process personal information in accordance with our Privacy Policy.

lThe App only collects data necessary for sleep tracking and health-related purposes.

lThe App does not use your data for commercial purposes.

7. Changes and Termination

lWe may update, upgrade, or adjust certain features of the App when necessary.

lWithin a reasonable scope, we may suspend or terminate part or all of the services, with prior notice where feasible.

 

8. Disclaimer

lThe App provides health tracking and recording functions only. It does not constitute medical advice, diagnosis, or treatment.

lThe App is not responsible for losses caused by your violation of this Agreement or by third-party actions.

lThe App is not liable for service interruptions or data loss caused by force majeure events such as natural disasters or network failures.

 

9. Governing Law and Dispute Resolution

lThis Agreement shall be governed by the laws of your country or region of residence.

lAny disputes shall first be resolved through friendly negotiation. If unresolved, disputes shall be submitted to the competent court in your jurisdiction.

 

10. Subscriptions

lYou will be automatically charged the price displayed on the payment screen (or Apple Pay pop-up screen) for the subscription period you selected, unless you cancel at least 24 hours before the end of the free trial. Your subscription will automatically renew at the end of each period (weekly, monthly, every 6 months, annually, or other specified duration) until you cancel. Payment will be charged to your iTunes & App Store/Apple ID account at confirmation of purchase (by accepting the subscription terms on the Apple pop-up screen using Touch ID, Face ID, or other means) or immediately after the end of the free trial period.

lYou can cancel a trial or subscription at any time by turning off auto-renewal in your account settings. To avoid charges, it's recommended to cancel your subscription at least 24 hours before the end of the free trial or current subscription period. You can manage your subscription directly by visiting the [Apple Customer Support page] for detailed management (including cancellation) instructions. Please note that deleting the app does not cancel your subscription (Apple iOS 13+ users may manage their subscription when deleting the app). For subscriptions purchased through the Apple App Store, you will need to submit a refund request directly to Apple and follow the instructions on the [Apple Customer Support page].
